Aziz-Ur-Rehman Moves SC Against Bail Cancellation; Case to Be Heard on August 4

Date:

Sri Vijaya Puram: Sri Vijaya Puram Municipal Council councillor Aziz-Ur-Rehman has approached the Supreme Court challenging the Calcutta High Court’s order cancelling his anticipatory and regular bail in the alleged casteist remarks case involving members of the Valmiki community. The matter is scheduled to be heard on August 4 by a Bench comprising Justice K.V. Viswanathan and Justice Arun Palli.

According to details available on the Supreme Court’s online case status portal, the petition has been registered as Special Leave Petition (Criminal) No. 013880 of 2026 after being filed on July 30. The matter has been listed as a motion hearing in a bail matter and is currently pending.

The Special Leave Petition has been filed against the Calcutta High Court’s July 28 judgment, in which the Circuit Bench at Port Blair allowed the Union Territory administration’s revision petition and set aside the anticipatory bail as well as the subsequent regular bail granted to Aziz-Ur-Rehman.

In its order, the High Court observed that the Sessions Court had failed to adequately consider witness statements and other material collected during the investigation before granting anticipatory bail. Holding that prima facie material existed for offences under the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, the High Court cancelled the relief granted to the councillor and directed him to surrender before the trial court within seven working days, failing which it ordered the issuance of a non-bailable warrant.

The criminal case stems from allegations that Aziz-Ur-Rehman made derogatory and caste-based remarks against members of the Valmiki community following a local dispute in Sri Vijaya Puram. Based on a complaint lodged by Sher Singh and others, Aberdeen Police registered a case under Sections 3(1)(r), 3(1)(u) and 3(2)(vii) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.

The controversy has triggered widespread protests by members of the Valmiki community, who have demanded stringent action against the councillor. Community representatives have maintained that the alleged remarks insulted the dignity of Scheduled Caste members and warranted prosecution under the provisions of the SC/ST (Prevention of Atrocities) Act.

The Supreme Court’s hearing on August 4 will determine whether Aziz-Ur-Rehman receives any interim protection from arrest or whether the Calcutta High Court’s directions requiring him to surrender continue to remain in force pending further proceedings.
